Premium Rent – General Terms and Conditions of Vehicle Rental

1. General Rental Conditions

1.1 In order to rent a vehicle, the Customer and any additional drivers must hold a valid national or international driving licence that has been valid for at least 12 months, and must present a valid identity document (ID card or passport) together with a valid credit card issued in the name of the main driver.

1.2 The Customer (whether an individual or a legal entity renting the vehicle) is solely responsible for obtaining and carrying all documents required to legally drive the rented vehicle, including, but not limited to, a valid driving licence proving the right to drive on public roads both in Romania and in any country the Customer intends to visit or transit with the rented vehicle. Premium Rent shall bear no liability in this respect.

1.3 By signing the Rental Agreement, the Customer expressly declares that they have read, understood and accepted both the Rental Agreement and these Terms and Conditions.

1.4 Premium Rent reserves the right to cancel the vehicle delivery or refuse any extension of the rental period if there are reasonable doubts regarding the Customer's financial capacity, outstanding debts, or any previous serious incidents involving Premium Rent.

1.5 The Customer expressly assumes full responsibility for renting and driving the vehicle within the territory of Romania and confirms that they possess all documents required by law, including an International Driving Permit where applicable, if they are not a citizen of a European Union Member State.

1.6 The Customer's right to use the rented vehicle is granted based on the national driving licence showing the date on which the driving entitlement was obtained.

2. Age Restrictions

2.1 The minimum age required to rent and drive a vehicle under standard rental conditions is 21 years.

2.2 Customers and additional drivers aged between 21 and 24 years are subject to a Young Driver Fee of €10 per day, up to a maximum of €100 per rental.

2.3 Customers and additional drivers aged 65 years or older are subject to a Senior Driver Fee of €10 per day, up to a maximum of €100 per rental.

Additional drivers must meet the same age and documentation requirements as the main renter.

The fee for each additional driver is €10 per day.

A maximum of three (3) additional drivers may be registered for each vehicle, and each additional driver is subject to both the applicable additional driver fee and the age restrictions described above.

3. Payment Methods

3.1 Cash payments and debit card payments are accepted only if the Zero Liability Protection Package has been purchased, except for Premium and Luxury vehicle categories (see Article 10 – Liability Protection Services).

Otherwise, the Customer is required to present a valid credit card when collecting the vehicle.

3.2 Payment for the rental period and any additional services selected may be made in full:

  • in advance by bank transfer;
  • online via www.premiumrent.ro;
  • or upon vehicle collection, at the time of signing the Rental Agreement, by credit card, debit card or cash.

3.3 Accepted credit cards are Visa and Mastercard.

Any security deposit (excess) refunds will be processed within 30 banking days after the end of the rental agreement.

3.4 Traffic fines and all administrative charges must be paid within 30 banking days from the date on which they are communicated to the Customer.

3.5 If the Customer decides to terminate the Rental Agreement before its scheduled expiry date, the total amount paid for the unused rental days (including all applicable taxes) shall be retained as compensation.

By signing the Rental Agreement, the Customer gives their irrevocable and unconditional consent for Premium Rent to recover any amounts owed due to breach of the Rental Agreement or damage caused to the rented vehicle by deducting such amounts from the security deposit. Should the security deposit be insufficient, Premium Rent shall be entitled to recover the remaining balance up to the full amount of the damage incurred.

4. Reservations and Rates

4.1 Rental rates are expressed in Euro (€) per day, inclusive of VAT, and are calculated according to the exchange rate established by Premium Drax on the date the transaction is processed

4.2 The daily rental rate includes:

  • Third Party Liability Insurance (RCA);
  • Romanian road tax (Rovinieta);
  • Roadside Assistance within Romania (telephone support);
  • Periodic vehicle inspections;
  • Seasonal tyres appropriate to the time of year.

5. Cancellation and Reservation Modification Policy

5.1 A reservation paid in advance may be cancelled up to 48 hours before the originally scheduled vehicle pick-up date and time. The amount paid will be refunded to the Customer's account within a minimum of 2 working days and a maximum of 365 working days, minus EUR 50. The retained amount represents bank fees and rental logistics costs.

5.2 If a reservation is cancelled less than 48 hours before the originally scheduled vehicle pick-up date and time, the advance payment is non-refundable.

5.3 All cancellations of prepaid reservations must be submitted in writing to reservation@premiumrent.ro.

5.4 For reservation modifications, Customers may contact Premium Rent by phone at +40 747 134 901 or by email at reservation@premiumrent.ro. Certain changes may affect the rental price, including but not limited to the pick-up/drop-off location, vehicle category, date, or time. In such cases, the Customer will be charged according to the current rates published on www.premiumrent.ro.

5.5 A vehicle reservation is considered CONFIRMED only after the Customer has accepted the rental offer and has received the “Reservation Confirmed” email containing the unique reservation code.

5.6 Reservations are confirmed for a vehicle class or category, not for a specific make or model. Premium Rent cannot guarantee a particular vehicle make, model, engine type, or colour.

5.7 If, at the time of delivery, Premium Rent does not have a vehicle available in the reserved category, it will provide a vehicle from a similar or immediately superior category at no additional cost.

6. Rental Period

6.1 The rental period is calculated in hours. One rental day consists of 24 hours, while 25 hours shall be considered two rental days. The rental period begins at the scheduled vehicle pick-up time and ends on the date and time when the vehicle, together with its keys and all related documents, is returned to an authorized Premium Rent representative.

6.2 A 59-minute grace period applies for vehicle returns. The maximum duration of a rental agreement is 30 days. Failure to return the vehicle on the date and time specified in the Rental Agreement entitles Premium Rent to charge the Customer for each additional rental day, together with a late return penalty of €25.

6.3 The Customer may collect the vehicle within a period ranging from 59 minutes up to a maximum of 12 hours after the scheduled pick-up time, subject to vehicle availability. Premium Rent will hold a vehicle from the reserved category provided that the Customer has notified Premium Rent in writing, at reservation@premiumrent.ro, of any delay before the scheduled pick-up time.

6.4 The rented vehicle shall be delivered together with a certified copy of the vehicle registration certificate in order to prevent criminal misuse. Upon request from any competent public authority, Premium Rent undertakes to provide the original registration certificate within 48 hours.

6.5 Vehicles are delivered in good mechanical condition, clean and sanitised, free from defects and free from any bodywork or interior damage, except for any damage recorded in the Vehicle Check-In/Check-Out Report.

6.6 Before signing the Vehicle Check-In/Check-Out Report, the Customer shall inspect the condition of the vehicle. Any objections regarding the vehicle's condition must be reported at the time of delivery and recorded in the "Delivery" section of the report. The Customer shall be fully responsible for any damage not recorded at delivery. No claims or objections regarding the vehicle's condition shall be accepted after delivery.

6.7 The Customer undertakes to return the vehicle, together with all documents, keys, accessories and equipment, in the same condition in which it was received, at the agreed location and on the agreed date specified in the Rental Agreement. Should the Customer require the vehicle for a longer period, a new reservation must be made at the rates and terms applicable on the new rental dates. A new Rental Agreement must also be signed at a Premium Rent office.

Rental extensions cannot be arranged by telephone. Electronic communication is accepted only if the Customer has declared an email address as their official means of communication in the Rental Agreement and submits the extension request at least 24 hours before the scheduled return date and time.

If Premium Rent is unable to confirm the extension due to vehicle availability or for any other reason, the vehicle must be returned at the agreed location, date and time specified in the Rental Agreement.

6.8 If the vehicle is returned more than 60 minutes after the agreed return time, Premium Rent reserves the right to charge the Customer in accordance with Article 6.2, unless the Customer has requested and obtained a rental extension in accordance with Article 6.7.

6.9 Any request to return the vehicle at a location other than the original return location must be communicated at least 24 hours in advance. Such requests will be charged in accordance with the applicable One Way Fee or Article 14.1, where applicable. The Customer shall bear all additional costs arising from the vehicle's immobilisation, breakdown or accident.

6.10 Premium Rent reserves the right to monitor its vehicles through remote electronic tracking systems, including GPS technology, and may locate, disable and recover any vehicle both within Romania and abroad.

6.11 The Customer remains fully responsible for the vehicle until the keys have been handed over to an authorised Premium Rent representative.

If the vehicle is returned during the night or in an excessively dirty condition preventing a proper inspection, the security deposit (or excess) will be released within two (2) working days, after Premium Rent has had the opportunity to inspect the vehicle under appropriate daylight and cleaning conditions.

In such cases, the Vehicle Return Report shall become effective only after the inspection period has been completed and not on the date it is signed.

6.12 Providing false or misleading information shall entitle Premium Rent to terminate the Rental Agreement before the agreed return date and time, following written notification delivered personally, by courier or by email to the Customer's contact details specified in the Rental Agreement.

Such notification shall be deemed received one day after dispatch, after which Premium Rent shall be entitled to recover possession of the vehicle.

7. Agreed Terms and Conditions

7.1 Customer Obligations

The Customer warrants that all information provided to Premium Rent and entered in the Rental Agreement is true, complete and accurate.

7.2 Persons who are not listed in the Rental Agreement as either the main driver or an authorised additional driver are not permitted to drive the rented vehicle in any country.

Any additional protection package purchased by the Customer shall become null and void if the vehicle is driven by an unauthorised person.

Should any damage occur to the rented vehicle, third parties or passengers while the vehicle is being driven by an unauthorised driver, the Customer shall bear full legal and financial responsibility for all resulting damages, claims, costs and liabilities. In such circumstances, all obligations of Premium Rent under the Rental Agreement shall cease to apply.

7.3 If the vehicle is returned more than three (3) hours after the return date and time specified in the Rental Agreement, Premium Rent reserves the right to report the vehicle as stolen to the Police, unless the Customer has previously notified Premium Rent in writing of their intention to extend the rental period in accordance with Article 6.7.

7.4 Returning the vehicle to a city other than the agreed return location is permitted only with Premium Rent's prior written approval and subject to operational availability. An additional One Way Fee shall apply, depending on the original rental location and the requested return location>.

7.5 Smoking is strictly prohibited inside all Premium Rent vehicles.

Failure to comply with this provision shall result in a cleaning and decontamination fee of €200.

8. Responsibilities of the Car Rental Company

8.1 Premium Rent undertakes to maintain the vehicle in accordance with the manufacturer's maintenance recommendations. At the date and time of delivery, the vehicle shall be in good mechanical condition and fit for its intended use.

8.2 If the vehicle becomes unfit for use due to a technical fault, Premium Rent shall replace it with a similar or equivalent vehicle within a maximum of 48 hours, subject to availability. If Premium Rent is unable to provide a replacement vehicle, the Customer shall be refunded for the unused portion of the rental period.

8.3 Premium Rent shall not be held liable for:

a) any claims, expenses or liabilities (including legal costs) that are not covered by the insurance included under the Rental Agreement (see Article 4.2);

b) any claims arising from the Customer's breach of the Rental Agreement or these General Terms and Conditions.

9. Customer Responsibilities During the Rental Period

9.1 The Customer accepts full financial, civil and criminal liability for any breach of the Rental Agreement or these Terms and Conditions.

9.2 The Customer undertakes to operate the vehicle in full compliance with all applicable traffic laws and regulations and agrees that the vehicle shall not be used:

a) in violation of any traffic, customs or other applicable laws or regulations;

b) for the transport of passengers or goods for hire or reward, or for pushing or towing another vehicle, trailer or any other object;

c) in races, competitions, speed tests, driving instruction, off-road driving, hunting activities or any other unlawful activity;

d) on roads officially closed to public traffic, while overloaded beyond the manufacturer's maximum authorised weight or passenger capacity as stated in the vehicle registration certificate;

e) for any illegal purpose whatsoever;

f) in flooded areas or for crossing rivers, streams or any other bodies of water.

9.3 The vehicle may only be driven by the Customer who signed the Rental Agreement or by an additional driver expressly authorised by Premium Rent and listed in the Rental Agreement.

9.4 Under no circumstances shall the Customer leave the vehicle unattended with its doors, windows, boot or sunroof open, nor leave the vehicle keys or registration documents inside the vehicle.

9.5 In the event of a mechanical failure or any other damage, repairs may only be carried out by an authorised repair workshop designated by Premium Rent and only with Premium Rent's prior knowledge, approval and instructions.

9.6 The Customer shall not, under any circumstances, sell, sublease, pledge or otherwise use the vehicle as collateral or security.

9.7 In the event of an accident, incident or mechanical breakdown, the Customer shall immediately notify Premium Rent by calling the 24/7 Roadside Assistance number +40 747 134 901. Premium Rent will provide the necessary assistance and instructions.

9.8 The Customer shall ensure that the correct type of fuel is used and shall regularly check and maintain adequate levels of engine oil and AdBlue® (for diesel vehicles). Failure to do so shall render the Customer liable for all resulting damage in accordance with repair estimates issued by authorised service centers.

9.9 The Customer shall regularly check and maintain the correct tire pressure and coolant level. Failure to do so shall render the Customer liable for any resulting damage.

9.10 The Customer is solely responsible for paying all bridge tolls and motorway charges (for example, the Fetești Bridge Toll on the A2 motorway) and must provide proof of payment when returning the vehicle.

Failure to provide such proof shall result in an administration fee of €25.

The Customer authorises Premium Rent to deduct the cost of any unpaid tolls, fines, administrative charges and a €25 administration fee from the security deposit.

If the security deposit is insufficient or has already been released, the Customer irrevocably authorises Premium Rent to charge the outstanding balance, in full, to the same credit or debit card used to pay for the rental vehicle.

10. Services and Liability Protection

All vehicles are standard insured under third-party liability insurance (RCA) for damages caused to third parties during the rental period specified in the Rental Agreement.

In the event of an accident, regardless of fault, all supporting accident documentation is mandatory.

If the vehicle develops a technical fault (provided it has been operated in accordance with the manufacturer’s instructions), Premium Rent shall provide the Customer with a replacement vehicle of the same or a higher category, subject to availability and geographical location, within a maximum of 48 hours from the receipt of the written notification.

10.1 - Basic Protection Service By signing the Rental Agreement, the Customer accepts the insurance terms with a deductible/excess, regardless of fault in the occurrence of an incident. The Customer’s financial liability applies up to a mandatory minimum amount in case of theft or damage to the rented vehicle.

The minimum amount represents the Customer’s contribution (excess) in the event of damage.

If the vehicle is returned in the same condition in which it was delivered, the security deposit will be fully refunded.

A valid credit card is mandatory for purchasing this service.

10.2 - Limited Liability Protection This is an optional service that reduces the Customer’s financial contribution in case of damage (hereinafter referred to as excess or deposit).

If the vehicle is returned in the same condition as it was received, the security deposit will be fully refunded.

The cost of this service varies depending on the vehicle category and rental duration.

A valid credit card is mandatory for purchasing this service.

10.3 - Zero Risk Protection This is an optional service that can be purchased prior to vehicle pick-up, providing zero liability in case of damage (except for Article 7.2).

The Zero Risk Protection covers the protections described in Articles 10.1 and 10.2, as well as damage to the vehicle’s exterior and mechanical components, including:

bodywork, bonnet, chassis, windshield, windows, mirrors, locks, wheels and tires, engine, clutch, battery, as well as immobilization costs related to financial losses during repair periods when the vehicle cannot be rented.

This product does not cover services not authorized by Premium Rent, including repairs, roadside assistance (Articles 8.3 and 9), excessive dirt (when more than standard cleaning is required), or interior damage to the vehicle.

10.4 - Replacement Vehicle in Case of Damage (Accident) Regardless of fault, the Customer may request a replacement vehicle, either:

  • subject to an additional charge as per Article 4, or
  • free of charge if the Customer has purchased the Zero Risk Protection, in the same or a higher vehicle category.

Depending on availability and location, Premium Rent will provide a replacement vehicle within a maximum of 48 hours from the written notification.

If a replacement vehicle is provided, the insurance cost for the remaining rental days will be calculated according to Articles 10.1–10.5.

Any protection service purchased applies to one single vehicle only.

11. Damage, Loss and Procedures

11.1 In the event of an accident, total or partial theft, or damage to the vehicle during the rental period, the Customer shall be liable as follows:

a) up to the amount retained as a security deposit, excess or guarantee (regardless of whether the event occurred due to the Customer’s exclusive or shared fault, or without fault), except where the damage is not covered by the insurance policies, in which case the Customer shall be fully liable for the entire loss, expressly agreeing to this by signing the Rental Agreement. Losses incurred by Premium Rent during the repair period shall be equal to the daily rental rate applicable for the period during which the vehicle is unavailable for use.

The Customer must notify Premium Rent as soon as possible, and no later than 24 hours after the incident, and must promptly provide all documents, letters, notices issued by third parties, as well as any documents related to potential legal proceedings.

11.2 In the event of an accident, damage or destruction, an amicable accident report between parties is not permitted. The Customer and all involved parties must report to the competent police authority for the issuance of an official accident report.

11.3 In the event of an accident, theft, destruction or damage, the Customer is required to present upon vehicle return:

a) the official police accident report and repair authorisation issued by the Romanian Police;

b) in case of an accident or damage involving a third party, whether or not the Customer is responsible: a copy of the driving license, identity documents, third-party RCA insurance, and vehicle registration certificate of the third party involved.

11.4 Failure to comply with Articles 11.1–11.3 shall render Articles 10.1–10.6, as well as any purchased liability protection services, null and void.

In such cases, the Customer shall be fully liable for all damages attributable to them, particularly those suffered by the vehicle, up to its market value, plus all related costs including transport, immobilization (loss of use), administrative and depreciation costs, as well as compensation for any damage caused to third parties.

In case of damage, the Customer is not permitted to continue using the vehicle without the Company’s authorisation, in order to prevent further damage.

11.5 The Customer shall pay a damage file administration fee of €50 per case for any of the situations described in Articles 11.1 to 11.3 and 11.7.

11.6 Towing and recovery costs are the responsibility of the Customer.

11.7 Incorrect refuelling or lack of fuel at the time of vehicle return is solely the responsibility of the Customer.

12. Fuel Policy

The vehicle, unless otherwise specified in the Vehicle Handover Report, will be delivered with a full fuel tank and must be returned with the same fuel level at the end of the rental period.

Regardless of the protection package purchased, the Customer shall pay a fuel deposit between €50 and €100, depending on the vehicle type and category, charged to a credit card at the rental counter.

The Customer shall pay in full for any missing fuel identified at the time of return, plus a refueling service fee in accordance with Article 14.3.

If the Customer purchases a prepaid fuel service, the vehicle may be returned with any fuel level. However, any unused fuel will not be refunded.

13. Cross-Border Travel

Vehicles are intended for use exclusively within the territory of Romania. Crossing the border is permitted only with prior written notification and express approval from Premium Rent (authorization).

A Border Fee shall apply as follows:

a) €150 for EU Member States

b) €250 for non-EU countries

c) Failure to comply with cross-border travel conditions shall result in a €1,000 penalty fee.

d) In the event of damage or technical issues abroad, the Customer is obliged to transport the vehicle back to Romania, to the original pick-up location, at their own expense.

e) Vehicles in the Premium and Luxury categories are not permitted to leave the territory of Romania.

14. Additional Services and Fees

14.1 - Relocation Fee (One-Way Drop-Off Fee)

Returning the vehicle to a different location than the original pick-up point.
For this service, the Customer shall pay €1 per kilometer travelled from the original pick-up location, plus a fixed €50 pick-up service fee.

14.2 - Cleaning Fee

If the vehicle requires more than a standard cleaning procedure to return it to its original condition (as at the time of delivery), the Customer shall pay a fee of €100 (interior detailing and cleaning).

14.3 - Fuel Policy Fee

Fuel is not included in the rental price. The Customer must return the vehicle with the same fuel level as at delivery, as recorded in the Vehicle Handover Report.

Otherwise, the Customer shall pay the cost of missing fuel plus a fixed refueling service fee of €25.

14.4 - Lost or Damaged Items Fee

If the Customer loses or damages vehicle keys, original vehicle documents, or optional equipment (parking tickets, license plates), Premium Rent shall charge a fee between €600 and €1,000.

15. Communication

Communication between the parties may take place by telephone only in urgent cases.

For all other matters related to changes in the Rental Agreement (such as rental extension, change of return location, etc.), communication must be made in writing, either by signing an addendum or via email, provided that the Customer has declared an email address as their official contact method in the personal data section.

The Customer acknowledges and agrees that any communication sent via email shall be considered official, legally binding, and admissible as evidence in Romanian courts.

16. Governing Law

The laws of the country in which this Agreement is signed shall apply to this Agreement.

Any court proceedings arising from this Agreement shall be governed by the applicable legislation of the relevant jurisdiction.

All fees stated in this annex include VAT.

17. Annexes and Company Information

These General Terms and Conditions are supplemented by the Damage and Cost Schedule Annex.
